EXECUTIVE LEVEL GRIEVANCE - UPDATES - 2/10

Surplus Employees Fail Rate on Consultant Test
Related to the fail rate of the surplus employees taking the secondary test or sales interview for the Consultant Job Title.  Considering the dire circumstances that have put these employees at risk of being remove from the payroll CWA requests that Verizon waive the secondary testing for these surplus employees.

Contractor Labor
Written notification of the intent to utilize contract labor was presented to West Virginia employees.  The co is in violation of the MOA, Broadband Network Employment Security Provision, Article 1, Article 39 and the Letter of Understanding regarding Contracting Initiatives of the Collective Bargaining Agreement.  CWA has exclusivity over the work Verizon has contracted.  CWA seeks Verizon's immediate compliance with the terms and conditions of the General Agreement.

Long Term Service Difficulty
Verizon is in violation of the General Agreement, LOU on Overtime Administration pages 159 and 160 and the LOU on Limitations on Mandatory Overtime page 161 of the General Agreement.  It is the opinion of the CWA that Verizon had no right to lift the caps citing a high trouble load as a long term service difficulty.  The high trouble load is a direct result of Verizon's continued refusal to properly staff its technician workforce.  CWA seeks Verizon's immediate compliance with the terms and conditions of the General Agreement.

Verizon's July 24th EISP Offers.
CWA is grieving the surplus declaration of these offers and the announcement to make force adjustments by applying the force adjustment provisions under Article 35 of the General Agreement.  Also, Verizon's unnecessary reduction of force while continuing the use of contractors to perform the work of CWA members in titles and locations covered by the EISP offers.  Verizon's declaration of "surplus" in CWA's view is caused in part by the use of contractors performing bargaining unit work.  The continues use of contractors is a violation of the spirit and intent of Article 39 and all other applicable articles related to contracting initiatives.  CWA requests that Verizon immediately comply with the terms and conditions of the General Agreement and an immediate cease and desist order regarding the forced transfer, layoff or part timing of any employee within the jurisdiction of CWA, District 2.
